
The Employment Amendment Act, 2021, No. 2 of 2021 (the Amendment Act) was assented to by the President on 30 March 2021 and shall come into force on 15 April 2021 as per the Gazette notice dated 1st April 2021.
The Amendment Act introduces pre-adoptive leave of 1 month with full pay to person(s) who apply and adopt a child in Kenya. According to the Amendment, the leave shall commence from the date of the placement of the child.
What is required from eligible employees? Employees eligible for pre-adoptive leave, are required to notify the employer in writing giving at least 14 days’ notice before the placement of the child.
Further, the notice to the employer shall be accompanied by legal documentation evidencing the intention of the adoption society to place the child in the custody of the employee, custo- dy agreement and an exit Certificate granted to the employee.
